JMU Law Firm’s members possess considerable and well-established experience in their respective areas of expertise within the field of litigation. With the help of a network of associates and correspondents, they can provide legal assistance throughout Italy and in major foreign countries. The difficulties in civil litigation in Italy, including prolonged duration and unforeseeable case outcomes due to conflicting opinions from judicial authorities, are widely recognised. Italy is not alone in this. At a 2022 conference in Australia, “Robert Heath KC described going to court as akin to playing Wheel of Fortune, as you never know what you're going to get”. The Firm's philosophy is therefore to promote out-of-court dispute resolution as much as possible (conciliation, mediation, other forms of ADR) and to use the courts as an extreme measure, i.e. only when absolutely necessary to best protect the client's interests. The Firm prioritises the balance between costs and benefits for its clients. Legal action will not be encouraged if the cost outweighs the potential outcome or if the opposing party is in a weak financial position. In the field of arbitration, both nationally and internationally, JMU Law Firm can pride itself on possessing a distinct and particular understanding of the arbitration community. Specifically, Mr. Jacopo Monaci Naldini is a regular arbitrator or party counsel, having participated in arbitrations administered by ICC, VIAC, CAM, Coffee Trade Federation. He has also acted as a consultant in Dispute Boards and Millennium Challenge Corporation proceedings. In addition to being a Fellow and member of the Faculty of the Chartered Institute of Arbitrators, he regularly participates in initiatives pertaining to international arbitration, including attending conferences and lecturing at universities and chambers of commerce. He has served as Chair of the European Branch of the Chartered Institute of Arbitrators from the year 2020 to 2023.
