International Contracts

The international agreement has unique factors that require consideration, including the determination of the relevant law, identifying the appropriate forum (the authority or arbitrator, Italian or foreign – responsible for resolving any contract conflicts), and the crucial decision on contractual language. There are, however, many other issues to be addressed on a case-by-case basis such as, for instance: the most appropriate method of payment and related guarantees, any limitations of liability and quantification of damages, costs and responsibilities regarding the transportation and delivery of the goods (regulated by the INCOTERM clause most relevant to the specific case), duration and mechanisms for withdrawal or renewal of the contract, and so forth.
